Who Qualifies for a K-1 Visa Classification?

K-1 visa is issued to a fiancé (e) of a U.S. citizen who enters the U.S. to marry his or her fiancé (e). National Visa Service Legal Department can submit your application for the K-1 visa in the U.S.

What Are the Requirements for a K-1 Visa?

While the INS processes the application, the beneficiary is outside the U.S.  Applications for K-1 visas are not accepted for processing outside of the U.S.

There are three requirements for a K-1 visa application:

1.      The couple must have met within two years before filing the application unless evidence of either of the following is submitted:

·        Compliance would result in extreme hardship to the U.S. citizen; or

·        Compliance would violate strict and long established customs of the K-1  visa holder’s foreign culture or practice

2.      The couple must have a bona fide intention to marry; and

3.      The couple must be legal and able to conclude a valid marriage in the U.S. within 90 days after the K-1 visa holder’s arrival.

A K-1 Visa holder’s dependent child is considered a K-2 nonimmigrant when accompanying the K-1 visa holder into the U.S.

How Long Is the K-1 Visa Valid?

The K-1 visa is valid for 90 days from the date of entry and permits employment.  You must marry the U.S. citizen within 90 days of entry into the U.S.  If you and the U.S. citizen do not marry within 90 days, you must depart the U.S.  After you and the U.S. citizen marry, application for legal permanent residence for the K-1 visa holder and any K-2 dependent children must be made with the INS.
